The business of Present2Sell (herein known as "P2S") is involved in the devising, creating, conveying, implementation and supervision of design solutions to the aesthetic issues relating to interior spaces.
Recommendations given by P2S are of aesthetic/cosmetic nature only. P2S's consultants do not provide structural recommendations, which should be provided by a qualified building surveyor and/or a structural engineer.
P2S does not give any guarantee that the Client will find buyers or tenants within a specific time or that the value of the property or rental will increase within a specific limit.
Cellars and loft spaces are not included in our consultants' remit and P2S reserves the right to exclude any area which may have unsafe or limited access.
All information provided by P2S is given in good faith.
P2S reserves the right to refuse to undertake any work which in its opinion would be legally fraudulent or illegal or in some way detrimental to its interests.
All orders must be confirmed in writing prior to the start of work.
The Client should ensure that they are satisfied with the cost effectiveness of recommendations made by P2S before implementing them.
The Client should ensure that the necessary health and safety precautions are in place prior to the start of any recommended work.
P2S may amend the type of goods and services previously recommended in writing, upon agreement with the Client.
P2S shall inform the Client of the date of commencement of work and an estimated completion date. Any date given is an estimate only. Whilst P2S will always endeavour to complete the services within estimated date, P2S shall not be held liable for any delays in completing the services.
P2S will honour all information, suggestions and recommendations given, verbally or in writing for a maximum of 6 weeks from the date supplied.
All P2S's services are payable as follows: Payment of design fees is due immediately on presentation of invoice. The cost of supplies, goods and material bought by P2S on behalf of the Clients is payable in advance prior to the purchase: services may only commence once payment is fully cleared.
Payment can be made in cash or cheque with a supporting card, on the basis of being paid on first presentation. The Client will be liable to pay any administrative charges made to P2S for each cheque returned unpaid (whether or not the cheque is honoured on re-presentation).
The Client is responsible for the payment of third party suppliers introduced or arranged by P2S.
Depending on the location of the property, and upon agreement with the Client, additional charges for travel and accommodation may be payable by the Client. Daily additional travel charges will be payable by the Client for any project lasting 5 days or more. The amount will depend on the location of the property and will be communicated to the Client prior to the start of work.
P2S may charge the Client 5% interest rate above the base rate of Abbey Business Banking should the Client fail to settle any outstanding payment. Interest would apply from the due date until full settlement is received. Should the need arise for P2S to instruct a debt recovery agency or to instigate legal proceedings, the Client will be liable for any costs so incurred.
P2S will supply goods and material of reasonable quality and which are adequate for their purpose.
In the case of project co-ordination, P2S will keep the Client informed on an on-going basis of accruing costs and will not exceed agreed budgets without the prior written agreement of the Client.
P2S will provide all services using reasonable care and skill.
P2S will inform the Client of any necessary changes to services or goods prior to completion.
P2S will use any personal information in accordance with the Data Protection Act 1998 and other applicable laws.
The Client shall give access to the property, at all reasonable times, to P2S's consultants or representatives, sub-contractors and suppliers for the purpose of providing services, goods and material.
The Client shall have in place adequate home content insurance to cover any and all items provided to the Client by P2S on a temporary basis. Any damage to or missing items must be reported in writing within 48 hours.
The Client shall ensure that water and electric supplies are available at the property to carry out services at no extra cost to P2S.
The Client is liable for any loss or damage to any goods, materials, tools or equipment delivered to or stored at the property unless P2S's representatives or suppliers fail to take reasonable care. P2S is not liable for any missing or damaged items after delivery and installation.
The Client may use his or her own contacts and suppliers. If P2S introduce third party suppliers, tradespersons or other specialists to the Client, the Client will form a direct contract with the third party and be responsible for the contractual relationship and all payments due to the third party.
If project co-ordination is requested by the Client, the Client will remain responsible for all financial aspects and full settlement of all services provided.
No administration charges will apply to the Client if the appointment is cancelled up to 48 hours prior the appointment date & time.
Cancellation made between 48 and 24 hours prior to the appointment date will incur a £50 charge to the Client or any other expenses paid by P2S in relation to the appointment (travel, accommodation, goods and deposit to third parties) in excess of £50 - whichever is the greater.
Cancellation made less than 24 hours prior to the appointment will incur a £100 or any other expenses paid by the Consultant in relation to the appointment (travel, accommodation, goods and deposit to third parties) in excess of £100 - whichever is the greater
The Client may cancel the contract after commencement of the services and will be liable for the payment of all services provided up to the date of cancellation.
P2S shall not be liable for any failure to provide the service due to unexpected circumstances or circumstances beyond its control.
P2S may use photographs or other type of footage of the property for publicity, advertising or promotion purpose. P2S will not reveal the identity of the property and its owner(s).
P2S is fully insured with Public and Product Liability Insurance, with AXA Insurance UK plc, certificates for which may be viewed by the Client on request.
P2S will not be liable to the Client for any breach of contract arising from or which may have been caused by Acts of God, Force Majeure, war, riot, civil commotion, Government orders, direction or legislation, or by fire, accident, strike, or other industrial action, adverse weather conditions, delays in transport systems or by any other matter which P2S has no control.
These terms and conditions shall be governed by and construed in accordance with English law and United Kingdom courts alone shall have any jurisdiction in any dispute between Present2Sell and its Client.
